I’m sure you’ve seen different companies using one of two different symbols when it comes to showing they claim trademark protection to their name/logo/slogan, etc.  Here’s the differences and why it matters which one you choose to use.

1. TM – The ™ symbol can be used by any person or business as an identifier of their services or products.  You do not need to have a registered trademark to use the ™ symbol. Most businesses will use it while they are waiting for their trademark application to get approved, but it is also a good way to show that you are claiming trademark to the name/logo/slogan.  Also, using the TM symbol over a period of time demonstrates you have been using the name/logo/slogan as a trademark over an extended period of time and it has become recognizable by consumers and is now a distinct identifier for your business. Conclusion: you can and should use the ™ symbol at the end of your name/logo/slogan even if you do not have a registered trademark with the USPTO.
   
   
2. Ⓡ – The Ⓡ symbol may only be used by companies that have an officially registered trademark with the USPTO.  The Ⓡ is obvioulsy more powerful and offers you a lot more protection as it is the symbol of a mark that is actually registered.  Conclusion:  Do not use the Ⓡ unless you have a registered trademark on file with the USPTO.
